Houston Wrongful Death Lawyer
Death Due to Negligence
Death is never an easy thing to deal with and it can be even more difficult to bear when you know that the death could have been avoided. If you are a surviving family member suffering from the loss of a loved one because of someone else's negligence, you may be entitled to compensation for your loss. A wrongful death lawsuit can be brought on behalf of a person who has died due to the negligence of a third party. In order for a lawsuit to be brought against the wrongful party, it must first be established that the person is deceased and died due to negligence, the deceased person has surviving family members and the family members have suffered emotionally and financially because of the loss.
Texas Survival Statute
The state of Texas has a statute called the survival statute, which allows the estate of a deceased person to bring a lawsuit against the negligent party for injuries that the deceased person could have sustained if they had survived the accident that ultimately killed them. This varies slightly from the wrongful death statute but these two statutes are often used together when file a claim. Instead of having any legal claims extinguished upon death, this statute allows family members to "stand in" for the deceased person in an effort to claim compensation for their death, lost wages, medical expenses and pain and suffering.
