Common Types of Birth Injuries
While some birth injuries are temporary, others can be long-term and even permanent. Many injuries sustained during birth could have been prevented if the doctor or nurse had followed proper medical procedures. When a delivery doctor or obstetrician fails to exercise the judgment, care and skill that a prudent professional would have exercised in similar circumstances, that physician is guilty of medical negligence.
There are several types of birth injuries that can occur as a result of complications during pregnancy, labor or child birth, including:
- Brain damage: Oxygen deprivation and problems with blood flow to an infant during labor often lead to infant brain damage. When oxygen is completely cut off, the baby experiences anoxic brain injury. Hypoxic brain injury happens when the baby receives some, but not enough, oxygen.
- Bruising: Bruising is common during delivery, especially if medical professionals use forceps or vacuum extraction to deliver the infant. Bruising can be accompanied by skull fractures that may need to be surgically repaired.
- Fractures: The most common forms of fractures occur to an infant's clavicle or collarbone. Often occurring in breech births, fractures may require surgery or other expensive medical procedures to repair.
- Cerebral palsy: One of the most serious types of birth injuries, cerebral palsy is a group of disorders that are caused by brain injury during birth. Cerebral palsy causes a variety of chronic physical and cognitive impairments, including tight/rigid muscles or joints, weak muscles or joints, seizures, tremors and poor coordination.
- Brachial Palsy: Also known as Brachial Plexus Palsy, Erb's Palsy, Duchenne's Palsy and Klumpke's Palsy, Brachial Palsy is an injury to the nerves in an infant's arms. This injury occurs during delivery, usually when a baby's shoulders do not pass smoothly through the birth canal. Doctors can do certain maneuvers to correct the problem. When they do not do these maneuvers, or are unsuccessful at them, it can result in upper arm paralysis and may need surgery to correct.
- Facial paralysis: Facial paralysis can occur when there is too much pressure on an infant's face during delivery. Surgical intervention may be needed to correct facial paralysis.
When a Physician's Negligence Leads to a Birth Injury
A physician has a duty to act promptly when there is a birth complication. For example, if the size of a baby will make it difficult to deliver the baby through the birth canal, the doctor must make decisions that will help protect the baby, such as ordering a C-section (cesarean section). When a doctor fails to act or makes a decision that other doctors would not make in similar circumstances, he or she may be held accountable for medical negligence.
We will investigate your claim and your infant's birth injuries. Then, we will give you a realistic evaluation of your case and the chances for success.
